1. Acceptance of Terms
By downloading, installing, browsing, or using the Zwet Food Delivery mobile application, PWA, or website (food.zwet.in), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.
These terms constitute a legally binding agreement between you ("Customer", "User") and Zwet Food Delivery. Any local custom or verbal agreement will not supersede these written terms.
2. User Eligibility & Account Registration
To use our ordering system, you must satisfy the following requirements:
- Age Limit: You must be at least 18 years of age, or ordering under the direct supervision of a parent or guardian.
- Phone Registration: You must register using a valid 10-digit Indian mobile number.
- OTP Verification: Account creation is completed only after verifying a 4-digit One-Time Password (OTP) sent to your provided email address.
- PIN Security: You must set a secure 4-digit PIN for future logins. You are solely responsible for keeping your PIN confidential.
3. Ordering Process, Pricing & Delivery Charges
We act as a local marketplace connecting you to food outlets. The rules governing orders and pricing include:
- Placing Orders: Once you checkout, your order details are securely transmitted to the outlet and our delivery network.
- Pricing: All food prices listed on the app are decided by the respective kitchens/outlets. While we try to ensure accuracy, typographical errors in prices may occur.
- Delivery Fees: Delivery charges are calculated dynamically based on the distance between the food outlet and your village/house location.
- Estimated Delivery Time (ETA): The ETA shown (e.g. 25-35 minutes) is a local estimate. While we pride ourselves on fast deliveries, actual ETAs can vary due to village road conditions, level crossings, weather, or peak hours.
4. Three-Way Marketplace Responsibilities
Zwet Food is a facilitator. Our network functions via distinct roles:
- Customer Responsibilities: You must provide an accurate drop-off address and a clear GPS location. You must remain contactable via your registered phone number when the rider is near your village.
- Restaurant Responsibilities: The preparing kitchens/restaurants are solely responsible for food hygiene, taste, quantity, correct ingredients, and packaging. Zwet Food is not liable for any issues related to food preparation.
- Delivery Partner Responsibilities: Delivery riders are responsible for carrying your food in clean bags, handling boxes with care, and delivering to the address listed in the order.
5. Cancellation & Refund Policy
Because food is perishable, cancellations are strictly monitored:
- Cancellation Window: You can cancel an order free of charge within 60 seconds of placing it. After this window, the outlet starts preparation, and cancellations are not permitted.
- Late Cancellation Penalty: If you cancel after preparation starts, or if you refuse Cash on Delivery (COD) at your door, Zwet Food reserves the right to suspend your COD privileges or deactivate your account.
- Refund Execution: Approved refunds for cancelled orders (where preparation hadn't started) or failed online transactions will be credited back to your original source account (UPI/Bank) within 5 to 7 working days, or instantly to your Zwet Coin balance if requested.
6. Failed Deliveries & Incorrect Addresses
A delivery is marked as "Failed" if our rider arrives at your location but cannot complete it due to:
- You providing an incorrect, incomplete, or out-of-boundary delivery address or pin.
- The contact phone number being unreachable, switched off, or ignored for more than 10 minutes upon arrival.
- No one being available at the door to accept and pay for the order.
Consequence: In any of the above situations, the order will be cancelled without refund, and the prepared food will be disposed of. For COD orders, the unpaid balance will be flagged as a outstanding debt on your account.
7. Safety & Location Restrictions
We value the physical safety of our delivery partners just as much as we value customer service:
- Unsafe Conditions: Delivery partners have the right to refuse doorstep delivery if the drop-off location is unsafe (e.g. unlit fields, broken walkways, threatening situations, or aggressive animals). In such cases, you will be requested to collect the order at the nearest safe public landmark.
- Illegal or Dangerous Locations: Zwet Food will not dispatch riders to illegal places, closed construction sites, or areas under official safety quarantine/blockade.
8. Limitations & Legal Boundaries
Please read these legal boundaries carefully:
- Limitation of Liability: Zwet Food is not liable for any direct or indirect loss, illness, or food poisoning arising from meals prepared by independent partner kitchens. We are an intermediary service provider.
- Intellectual Property: All content, logos, designs, software, and databases (including menu layouts and App designs) are owned by Zwet Food and LALSINGH. Copying, distributing, or hacking any code is strictly prohibited.
- Prohibited Activities: Scraping menu items, creating multiple dummy phone accounts to exploit referral bonuses, or using automated scripts is grounds for immediate ban and legal action.
- Privacy Link: Our usage of your data is governed by our Privacy Policy.
9. Governing Law & Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of India.
Any disputes, claims, or controversies arising out of your usage of the Zwet platform will be subject to the exclusive jurisdiction of the competent courts located in Mathura, Uttar Pradesh, India.
10. Changes to Terms
Zwet Food reserves the right to modify these Terms & Conditions at any time. When updates are published, the revised version will be uploaded to this page with an updated "Effective Date". Continued use of the platform after updates indicates your agreement to the new terms.
